The Old Judge brand was originated in 1857 by M.T. Mitchell. It was acquired in 1899 by S.C. Hebst, a Milwaukee wholesaler, who also bought the distillery in Frankfort (distillery #11). This had previously been the John E. Fitzgerald distillery, and it continued producing both brands following acquisition.
Old Judge was distributed in the West by Sara Rothenberg and by her son, Samuel B. Rothenberg, who took over the business in 1898. Samuel Rothenberg also registered the brand.

Rothenberg sold several brands, including "Mendles Game Cock", "Old Judge" (R: 1902), "Quaker Club", and "Rosemond A".
